CASK PURCHASE AGREEMENT PURCHASER . residing at being a .national, henceforth referred to as "Purchaser" Has today purchased cask number .. Contents when filled ....bulk litres of new make spirit, at 63.5% ABV (Alcohol By Volume) or .... litres of alcohol (OLAs - original litres of alcohol), filled on the th day of .. in the year 2009., and warehoused, under bond, at the Bladnoch Distillery, Wigtown, Scotland, DG9 9AB, the Purchaser and the Distillery having agreed the terms set forth herein. PRICE £1250.00 under bond, (Excise Duty plus VAT payable by the Purchaser upon removal from Bond). A receipted invoice will be issued upon payment. STORAGE The above price includes warehousing for 8 years as of the date of filling, which period may be prolonged. This is subject to the agreement of the Distillery and its then current charges. INSURANCE The cask is included in the Distillery's group policy for as long as the warehousing has been paid in full, as set forth above. TITLE The title to the above mentioned cask lies with the Purchasers, subject to the Purchaser supplying the Distillery with a Delivery Order (template to be issued by the Distillery, subsequent to this purchase). CASK VISITS The Purchaser may visit the Distillery and inspect the above mentioned cask upon appointment, during normal opening hours. BOTTLING The whisky will lose volume and strength during maturation, as well as acquiring colour and character from the cask. As the maturation process will vary from one cask to another, the Distillery does not guarantee any result from the spirit inside the cask, regardless of the length of the maturation, but only that the spirit filled into the cask is/was of an adequate quality and character. Bottling charges or labels are not included in the above price. The Distillery does not have a bottling plant, but will assist in supplying contact details of suitable bottling companies, Subject to availability and current legislation, bottling by hand may be quoted upon request. The Purchaser is reminded that duties, VAT and other charges must be paid before the cask is removed from bond. The age at which the whisky will be bottled is 8 years unless determined otherwise with the agreement of all purchasers and the distillery. In the event of agreement not being possible purchasers herby agree that the decision of the distillery is binding. LABELLING The whisky, when bottled, may not be labelled "Bladnoch" in bold or otherwise distinguished letters, but the labels may bear the sentence "Distilled at Bladnoch Distillery, Scotland, and privately bottled." in uniform, non-distinguished letters to the base of the label. The Purchaser is aware that any breach of this covenant will cause damage to the Distillery's rights in its trade mark, for which the Purchaser is liable. Further other labelling requirements do apply by law. RE-SALE Should the contents of a cask become surplus to the Purchaser's requirements; the Distillery shall be entitled to make an offer on re- acquiring the alcohol, at the current market rates. Should the cask be sold on to a third party, this must promptly be reported to the Distillery and the Distillery may apply an additional charge for the administration in conjunction therewith to be paid by, or on behalf of, the Purchaser. It is the responsibility of the purchaser to keep the distillery informed of any change of address.
